    4. Cobranded partners are entitieswith whom we work to offer a service or feature. In the event PremiumBrands goes through a transition (such as a merger, acquisition, bankruptcyor sale of all or a portion of its assets, including, without limitation,during any due diligence process), your data will likely be among the assetstransferred. By providing your personal data, you agree that we may transfersuch data to the acquiring entity without your further consent.

    13. Administrative and Legal Reasons.

Premium Brands reservesthe right to use or disclose any data as needed to satisfy any law,regulation or legal request; to protect the integrity of the Channels; tofulfill your requests; to cooperate in any law enforcement investigation, aninvestigation on a public safety matter, or an investigation into claims ofintellectual-property infringement; to protect and defend the legal rightsor property of Premium Brands, our parent company, affiliates andshareholders, any Channel or its users, or any other party; or, in anemergency, to protect the health and safety of our users or the generalpublic. This includes exchanging data with other companies and organizationsfor fraud protection and credit risk reduction.

  • Third Party Advertising and Analytics/Privacy Controls
  • We may work with network advertisers, ad agencies, analytics serviceproviders, and other vendors to serve our advertisem*nts on our Channels andthird-party websites, apps, and elsewhere online and to provide us with dataregarding use of and traffic on the Channels (including without limitationthe pages viewed and the actions users take when visiting the Channels) andthe effectiveness of our advertisem*nts. For example, if you click on anadvertisem*nt for Premium Brands, our service provider(s) may be able totell us the advertisem*nt you clicked on and where you were viewing theadvertisem*nt. The advertisem*nts you see may be served by us or one or morethird parties, who may use data about your activities on the Channels, andother websites and services you visit across the various devices you use, toprovide you targeted content and advertising. Our service providers maycollect certain data about your visits to and activity on the Channels andother websites and services and may use this data to target advertising toyou.

    These third parties may set and access their own tracking technologies onyour device (including without limitation cookies and web beacons) and mayotherwise collect or have access to information about you (such as DeviceID/Interaction Information). Some of these parties may collect personal dataover time when you visit the Channels or other online websites and services.Cookies and web beacons, including without limitation those set bythird-party network advertisers, may be used to (among other things): targetadvertisem*nts, prevent you from seeing the same advertisem*nts too manytimes, and conduct research regarding the usefulness of certainadvertisem*nts to you. We may share certain data such as device identifiers,Device ID/Interaction Information, hashed information, records oftransactions you conduct on our Channels or offline, and other types ofde-identified or pseudonymized data with third-party advertising companies,analytics providers, and other vendors for advertising and analyticspurposes. In addition, we and our third-party service providers may use thisdata to perform matching with third-party cookies to provide targeted onlinemarketing.   • Loyalty Program Disclosures
  • We provide the StyleRewards Program which provides you with loyalty benefitssuch as points on your eligible purchases that are redeemable for credit onyour purchases, access to exclusive offers, and the ability to maintain wishlists and your order history.     Through our StyleRewards program, we process the following personal data:membership number; points accrued as a StyleRewards member; data related toredemption of Rewards Certificates, date of birth ("Loyalty Program Data").Loyalty Program Data is personal data that would not be collected,processed, sold, or shared if you were not a member of the StyleRewardsprogram. This section discusses our practices in relation only to LoyaltyProgram Data. We may collect, process, sell, and share other personal dataof members and non-members alike, including for targeted advertising, as setforth in other sections of this Privacy Policy.

    Premium Brands does not sell for targeted advertising purposes LoyaltyProgram Data.

    The StyleRewards program does not include loyalty program partners, which isdefined as an unaffiliated third party who offers benefits to a company’sloyalty program members. However, the following thirdparties may receive Loyalty Program Data: advertising and analyticspartners, technology systems service providers, security vendors, and otherservice providers who use your data solely to provide services to us or toyou.

    Impact of Deletion of Personal Data: If you are a StyleRewards member whois eligible to and chooses to exercise your right to delete your personaldata, then your StyleRewards account, including the unique membershipidentification number, any accrued points associated with the account, yourcontact information, and any other information tied to your membershipaccount will also be deleted. There is no benefit of the StyleRewardsprogram that can be extended to you after the deletion of your personaldata.

    • Our program is based on points which accrue to your unique membershipidentification number based on your purchases. Points are debited basedon your point redemptions and returns. Without the ability to relate andtrack your transactions to the membership identification number thatwill be deleted as a result of your deletion request, we will be unableto add or deduct points based on your transaction activity, or accessany previously accrued points.
    • Without your email address, we will be unable to send you member-onlyoffers such as seasonal and exclusives deals.
    • Once your unique membership identification number is deleted from oursystems, we will be unable to recognize your membership identificationnumber to provide you with access to your order history, wish lists, andother member-only benefits that we may offer from time to time.

    All registered users of a Channel have the right to request the removal ofcertain content that (they have publicly posted on the Channel. A user canrequest that we remove content (s)he has previously posted by contacting ususing the information listed in the "Contact Us" section below. Whensubmitting a request, please be sure to include your full name, emailaddress, and information sufficient to permit us to locate the UserSubmission(s) for which you are requesting removal (e.g., for productreviews, a URL of the product page and the username under which you postedyour review).   • Premium Brands is a United States company. Please be aware that data wecollect will be transferred to and processed in the United States and othercountries. By using the Channels, or providing us with any information, youfully understand and unambiguously consent to this transfer, processing, andstorage of your data in the United States and other jurisdictions, for whichthe privacy laws may not be as comprehensive as those in the country whereyou reside and/or are a citizen. As a result, this data may be subject toaccess requests from governments, courts, or law enforcement in the UnitedStates and other countries according to laws in those jurisdictions.   • This section of the Privacy Policy applies only if you use our onlineChannels from a country that is a Member State of the European Union orEuropean Economic Area (collectively, "EU") or the United Kingdom ("UK"),and it supplements the information in the remainder of our Privacy Policy,above. If you choose to transact with us, your order will be processed andshipped through a third party, Borderfree, as further described above.

    This section sets forth our compliance with the European Union General DataProtection Regulation and the UK General Data Protection Regulation(collectively, "GDPR") and your rights under the GDPR, where applicable. ForGDPR purposes, Premium Brands is a data "controller" for processing ofinformation defined as personal data under applicable data protection law("Personal Data").     Legal Basis for Data Processing

    We process Personal Data for the purposes set out above in our PrivacyPolicy. Our legal basis to process Personal Data includes processing thatis:

    • necessary to comply with legal requirements (for example, to comply withapplicable accounting rules and to make mandatory disclosures to lawenforcement);

    EU and UK Data Subject Rights

    The GDPR and UK Data Protection Act provide certain rights for individuals("data subjects"). You can access information about you and update orcorrect it.     Retention of Information

    We retain your Personal Data while you have an account with us and while youcontinue to use or visit any of the Channels.
