Session Replay Technology

Premium Brands may record through session replaytechnology your interactions with the Channels, such as what pages you visiton the Channels, how long you visit those pages, and any links you click orinformation you provide. Community Forums and User Submissions.

The Channels mayprovide you the opportunity to submit information to us, through interactivefeatures, and through other communication functionality ("Community Forums"). For clarity, PremiumBrands does not create a record of facial geometry from your photos orvideos, and does not use your photos or videos for the purposes of facialrecognition, facial surveillance, or otherwise as a biometric identifier.Please note, however, that to the extent that you post your photos or videospublicly on our Channels, or we share – as described elsewhere in thisPrivacy Policy – such materials with third parties who are permitted to usethese materials in accordance with their own privacy policies, we do notcontrol the actions of third parties, and their use of your photos or videosmay differ from ours.

Social Networking Features.

Functionality on the Channelsmay permit interactions between the Channels and a third-party service suchas Facebook or Instagram ("Social Networking Features"). Examples of SocialNetworking Features include enabling you to "like" or "share" content fromthe Channels or to "like" or "share" our content on a third-party service;to automatically or selectively show your social media posts on theChannels; and to otherwise connect the Channels to a third-party service. Ifyou choose to share content or to otherwise post information through theChannels to a third-party service, or vice versa, that information may bepublicly displayed. Similarly, if you post information on a third-partyservice that references us (for example, by using a hashtag associated withus in your post), your post may be published on the Channels or otherwise inaccordance with the terms of that third party. Send-to-a-Friend Features.

We may make available on theChannels a "send-to-a-friend," "refer a friend," "wishlist" or similarfunction that permits you to send Channel content directly to a third partythrough the Channels. If you send a friend a communication using suchfunctionality, the information you provide about your friend (e.g., name ande-mail address) is used to facilitate the communication and is not used forany other marketing purpose unless we obtain consent from that person. Ifyou disclose any personal data relating to other people, you represent thatyou have the authority to do so and to permit us to use the data inaccordance with this Privacy Policy.

Data We Disclose to Third Parties.

We may sharenon-personal data, such as certain Device ID/Interaction Information,hashed or otherwise de-identified or pseudonymized data, and aggregateduser statistics, with third parties in our discretion and as permittedby law, including for targeted advertising purposes. Cobranded Credit Card.

When you apply for and use a brandedcredit card, Premium Brands may share certain data at your direction tofacilitate your application and use of the card. In addition, Premium Brandsmay share data with the issuing bank for our Ann Taylor or LOFT Credit Card,and its affiliates, for purposes related to those credit cards. For example,we may share information to send joint offerings, including information onhow to apply for a Premium Brands Ann Taylor or LOFT cobranded credit card,and in connection with your use of Premium Brands Ann Taylor or LOFTcobranded Credit Card, such as to maintain or service accounts and toeffectuate transactions. We may also share data with these parties foranalytics purposes.

Other Cobranded Partners.

Cobranded partners are entitieswith whom we work to offer a service or feature. You can typically tell whenyou are accessing a service offered by a cobranded partner because thecobranded partner’s name will be featured prominently. You may be asked toprovide information about yourself to utilize a feature offered by acobranded partner. In doing so, you may be providing your information toboth us and to the cobranded partner, or we may share your data with thecobranded partner to allow you to participate in the feature. We may also offer scrip programs (which allow you to instruct us to divert apercentage of the amount you spend on purchases to participating schools andother non-profit organizations) or third-party programs that allow you toearn "points" on purchases through a Channel and use the points towardcertain rewards offered by the third party program. If we offer this type ofprogram, where Premium Brands is a participating vendor and you choose toparticipate, you authorize Premium Brands or our payment processor toprovide data about your purchases to the company administering the program.In such case, the data we will share with that program administrator mayinclude your name, payment information, the date and amount of yourpurchase, and other information. Affiliated Brands for Direct Marketing.

Premium Brands mayshare your information with companies associated with the LOFT, ANN TAYLORand LOU & GREY brands, which like Premium Brands are also owned,directly or indirectly, by the same parent companies ("Affiliated Brands"),for business, analytical, and operational purposes. We also share personaldata with these affiliated companies so that they may contact you with theirown direct marketing. You may opt out of our sharing personal data we havecollected about you with Affiliated Brands for their direct marketingpurposes as described in the "Updating Your Personal Data" section below.

Unaffiliated Third Parties for Direct Marketing.

We mayshare personal data with unaffiliated third parties for their own directmarketing and other purposes. Third Parties Providing Services to Us or on Our Behalf.

Loyalty Program Disclosures

We provide the StyleRewards Program which provides you with loyalty benefitssuch as points on your eligible purchases that are redeemable for credit onyour purchases, access to exclusive offers, and the ability to maintain wishlists and your order history. Premium Brands does not sell for targeted advertising purposes LoyaltyProgram Data.

The StyleRewards program does not include loyalty program partners, which isdefined as an unaffiliated third party who offers benefits to a company’sloyalty program members. However, the following thirdparties may receive Loyalty Program Data: advertising and analyticspartners, technology systems service providers, security vendors, and otherservice providers who use your data solely to provide services to us or toyou.

Impact of Deletion of Personal Data: If you are a StyleRewards member whois eligible to and chooses to exercise your right to delete your personaldata, then your StyleRewards account, including the unique membershipidentification number, any accrued points associated with the account, yourcontact information, and any other information tied to your membershipaccount will also be deleted. There is no benefit of the StyleRewardsprogram that can be extended to you after the deletion of your personaldata.

Our program is based on points which accrue to your unique membershipidentification number based on your purchases. Points are debited basedon your point redemptions and returns. Without the ability to relate andtrack your transactions to the membership identification number thatwill be deleted as a result of your deletion request, we will be unableto add or deduct points based on your transaction activity, or accessany previously accrued points.
Without your email address, we will be unable to send you member-onlyoffers such as seasonal and exclusives deals.
Once your unique membership identification number is deleted from oursystems, we will be unable to recognize your membership identificationnumber to provide you with access to your order history, wish lists, andother member-only benefits that we may offer from time to time.

Consent to Transfer and Storage in the United States

Premium Brands is a United States company. Please be aware that data wecollect will be transferred to and processed in the United States and othercountries. By using the Channels, or providing us with any information, youfully understand and unambiguously consent to this transfer, processing, andstorage of your data in the United States and other jurisdictions, for whichthe privacy laws may not be as comprehensive as those in the country whereyou reside and/or are a citizen. As a result, this data may be subject toaccess requests from governments, courts, or law enforcement in the UnitedStates and other countries according to laws in those jurisdictions. Our Channels are intended for a general audience and are not intended foruse by or targeted to children younger than the age of 18. Retention of Information

Premium Brands will not retain Personal Information for longer than isreasonably necessary for each disclosed purpose outlined in this CaliforniaPrivacy Notice and our Privacy Policy, and as otherwise needed to addresstax, corporate, compliance, litigation, and other legal rights andobligations.
